I live in Pennsylvania and I was working at a Japanese restaurant and took off for 3 weeks because of some personal problem and I was suppose to go back. I called them on my last week off and they said they would call me, it's been a couple of weeks now, they have not called me or given me a schedule. Would this consider being laid off? If so, how could I get unemployment from it? I am a citizen and I do do my income tax within PA. I am not working under the table. plus I did apply for this job. I did ask for the 3 weeks off

Are you sure you were actually signed up to work there? Where you paying state income taxes? If they were paying you cash then most likely they dont have anything on file for you. You can't get unemployment if you're not on file with the state.

It also depends on whether or not you notified your employer that you were taking off. If you did not, that is considered "job abandonment " and is the same as quitting.
