Fired for missing too much work because of health - can i file for unemployment?

Question: Fired for missing too much work because of health - can i file for unemployment?

(Posted by: California on 2010-03-10 13:02:49)

I got fired today for missing too much work. I suffer from chronic depression, back pain (had one surgery and need another) and endometriosis. I tried to work as much from home as possible and was never told I couldn't do that until today. My state requirements for unemployment are that workers are eligible if they are let go "through no fault of their own. " They said they are "trying " to keep me on the payroll through the end of the month. Do you think I could apply for unemployment? What about disability?

Most states are require a 3 warning rule prior to firing. Did you notify them each time why you couldn't work? Were there doctor's notices of your back pain or your chronic depression? You cannot just say "I am too depressed to work today " and expect that there will be no repercussions. If your doctor said you could go to work, then you should have gone. If they are trying to keep you on until the end of the month, I think they are genuinely trying. The application for disability will take a doctor's agreement that you cannot work.
