Question: Can i ask to get laid off?
(Posted by: Colin S on 2010-03-15 14:35:42)
Hi, I've been working for my company for about 4 years. I've recently been passed over for a number of promotions despite being told that I would receive them, and it's becoming abundantly clear that, though I'm still a good employee, it's going to be impossible for me to have the future here that I want. My bosses respect me and know that I'm very frustrated by being passed over for the promotions, and they also know that I haven't necessarily been treated fairly in the process. Additionally, I'd like to take some time off and pursue another field. Can I ask to be laid off? I'm not as concerned with getting a severance (though it would be nice) but more being able to apply for unemployment. |

In order to collect unemployment, you have to have lost your job through no fault of your own. Asking to lose your job would eliminate your eligibility for unemployment. And your employer is not going to notify UI that you were laid off if the reason you left is because you asked to leave. That would be fraud and no employee (no matter how unfairly they've been treated) is worth the risk. So, bottom-line, your choices are limited to staying in the same job or getting a new one. You'll have to pursue another field in your spare time. |

You can ask, but keep in mind every time they have a lay off or someone collects unemployment the portion they pay the state goes up, so they may not be inclined to grant you your wish |

No. It is illegal for them to honor such a request and they probably won't do it. Start looking for another job and resign with dignity. If you get another offer, the leverage could be useful. |
